The Chinese University & University of Cambridge Joint Scholarship for Young Academics

The Joint Conference is convened by the School of Law, The Chinese University of Hong Kong, and the Centre for Public Law, University of Cambridge, in order to make a constructive and significant contribution to debate about judicial review across the world. The central belief of the organisers is that the core values of judicial review – fidelity to the rule of law, procedural fairness and respect for fundamental rights – transcend constitutional and other differences between different legal systems. Thus we may all learn from each other; and it is in that spirit that this conference is convened.

The organisers have finalised the Joint Conference programme. The Joint Conference on Effective Judicial Review will be held in Hong Kong from 10-12 December 2008 and will consider the following topics:

  • The functions of judicial review - upholding the rule of law, ensuring executive accountability, the ‘fundamental right’ to administrative justice.
  • The necessities for effective judicial review – an independent judiciary, and an impartial, uncorrupted, civil service.
  • The legitimacy and scope of judicial review: Differences between written and unwritten constitutions; the importance of legitimacy; the distinction between appeal and review.
  • The grounds of judicial review: irrationality, proportionality, legitimate expectations
  • Administrative Law Remedies: Declaratory relief, Coercive relief, damages for Maladministration
  • A comparative and substantive examination of judicial review in China, the Hong Kong Special Administrative Region, United States of America, India, Canada, Australia, South Africa and New Zealand

The Joint Conference organisers have set up a fund from which scholarships will be awarded to young academics. The scholarship aims to provide young academics with financial support and also the opportunity to present a paper before eminent lawyers and academics in the field. The scholarship will cover registration costs for the Conference and will include some contribution towards associated costs.

Interested applicants will need to submit a paper relating to the main conference theme (Effective Judicial Review: A Cornerstone of Good Governance).

Information for interested applicants:

  • Applicants must have held a full time salaried teaching or research post for less than five years or must be currently enrolled as a full time postgraduate student at a tertiary institution.
  • The scholarship is open to applicants from any jurisdiction.
  • The maximum word limit for the paper is 3,000 words (including footnotes and references). The paper must be original and unpublished.
  • Papers must be submitted by email in MS WORD format to cuhkcam.lawconf@cuhk.edu.hk . Papers must be accompanied with a CV of the applicant.
  • Each applicant may submit only one paper.
  • The closing date for applications is 30 May 2008.
  • The scholarship will cover registration costs and some associated costs.
  • Successful applicants will be responsible for all remaining costs.
  • Successful applicants will be given the opportunity to present their paper at a dedicated Young Academics Forum during the course of the Conference.
